Expunction Information

Expunctions Procedures in Wood County

In Wood County, any one of our Four (4) elected justices of the peace officials may magistrate and normally take turns doing so.  Therefore, unless the person seeking the expunction was arrested by an agency other than the Wood County Sheriff's Office, you must include the correct magistrate in your application and order of expunction to ensure the person's arrest file is completely expunged.

The following is a list of agencies normally involved in the expunction process.  Please include the physical or mailing and email address of each agency in your petition.  Duplicate agencies will not be notified.  No "issue expunction-certified mail" fee is required if you include the agency's email addresses in the petition/order.

This list is not all inclusive. Any outside agency that has available or published information concerning the charge or arrest should be included. There is a $25 fee for each agency included in the petition that does not have an email address to cover expense of certified mail to transmit application with notice and final order. The petition should include both the physical (or mailing) address as well as the e-mail address for each agency. Texas Code of Criminal Procedure Article 55A.253(b) prohibits a petition from listing any state or local agency more than once or including multiple contacts or addresses for different divisions with respect to the same state or local agency. The District Clerk's Office cannot provide legal advice nor provide forms for filing an expunction. For assistance with the process please contact an attorney or consult www.texaslawhelp.org

Self-Represented Litigants

An expunction order obliterates an arrest from the person’s criminal history record and all files associated with the arrest and charge.  There are certain conditions that must be met to be eligible for an expunction.  For this information and more, you are encouraged to consult with an attorney.
